Terms of Use

This is the terms of use from the legal text available inside Her:Him. Privacy and Terms together describe the service.
1. scope and acceptance
These Terms of Use and Privacy Notice apply to the her:him mobile app, voice conversations, transcripts, memory, live tools, proactive features, connected accounts, notifications and purchases (together, the “Service”). By selecting “accept terms & continue”, you agree to the Terms and acknowledge this Privacy Notice. Optional connections, background discovery and proactive notifications are not authorised by this general acceptance. They require their own in-app choice and can be turned off again.
2. who operates her:him
Novi Forum d.o.o. operates the Service and is the controller for personal data processed for the Service. Registered office: Ulica Roberta Frangeša-Mihanovića 6, 10000 Zagreb, Croatia. 3. what Her is — and is not
Her and Him are AI personas, not people. The Service uses generative AI and can produce inaccurate, incomplete, inappropriate or outdated statements. It may misunderstand speech, memory or external sources. Verify anything important. The Service is for companionship, reflection and entertainment. It is not a doctor, therapist, lawyer, financial adviser, emergency service or substitute for a qualified professional. If you may harm yourself or someone else, contact local emergency services or a crisis service immediately.

The Service is not intended for anyone under 16. Do not create or use an account if you are younger than 16. Contact us if you believe a child has provided personal data contrary to this rule.
17. acceptable use and your content
Use the Service lawfully. Do not use it to harm, threaten, exploit or impersonate others; violate privacy, intellectual-property or other rights; distribute malware; extract credentials; evade safeguards; interfere with the Service; or gain unauthorised access. We may limit or suspend access where reasonably necessary to stop abuse, fraud, security risk or legal violations. You keep your rights in content you provide. You grant us only the permission needed to process that content to operate, secure and improve the requested Service. You are responsible for having the right to provide personal data or content about other people. AI output may be subject to third-party rights and is not guaranteed to be unique.
18. conversation time and purchases
A new account may receive free conversation time. Additional time is a consumable in-app purchase through Apple’s App Store or Google Play at the price shown before purchase. There is currently no recurring subscription. Remaining time has no cash value and is lost when the account is deleted. Your app store processes payment and applicable refund requests; mandatory consumer rights remain unaffected.
19. availability, changes and termination
AI models, external tools, prices and features may change, be unavailable or be withdrawn. We may update the Service and these Terms. For a material change, we will present the new version in the app and require a new acceptance before protected features continue. We may terminate the Service or an account for serious or repeated breach, subject to applicable law.
20. responsibility and applicable law
The Service is provided with reasonable care but AI and third-party information cannot be guaranteed to be accurate or continuously available. To the extent permitted by law, we are not responsible for loss caused by relying on unverified AI output or by external services outside our control. Nothing in these Terms excludes liability or remedies that cannot legally be excluded, including mandatory consumer and data-protection rights. Croatian law applies unless the mandatory law of your country of residence gives you greater protection. Courts are determined by applicable consumer and procedural law.
